Opal digital terms and conditions

The Opal Digital Card is issued on behalf of Transport for New South Wales (TfNSW) by EML Payment Solutions Limited ABN 30 131 436 532 (Issuer or EML) and will be provisioned into a Mobile Wallet on a Mobile Device (Opal Digital Card). The Opal Digital Card is managed by Mastercard Prepaid Management Services Australia Pty Ltd ABN 47 145 452 044 (Mastercard Prepaid or Program Manager).

By ordering, registering or provisioning the Opal Digital Card you are entering into a contractual relationship with the Issuer, not with TfNSW.

WHAT IS THE OPAL DIGITAL CARD?

  1. Opal Digital Ticketing System:The Opal Digital Card is a virtual card designed for use on the electronic ticketing system (Opal Ticketing System) of TfNSW. The Opal Digital Card is available only within a Mobile Wallet (such as Samsung Pay or Apple Pay (Mobile Wallet)) of certain supported mobile devices as determined from time to time by the Issuer, including a mobile phone or certain wearable devices such as a smartwatch, (Mobile Device) and is not available in physical card form, even if you cease to have access to a Mobile Device.

 

  1. The Opal Digital Card can be used on the Opal Ticketing System as a form of ticketing and payment for public transport services within the metropolitan areas of Sydney, Newcastle and Wollongong equipped with Opal Card readers (Opal Card Readers) on which the Opal Digital Card is an accepted form of fare payment (Transport Services). In this document, the terms “we”, “us” or “our” refer to the Issuer; and the terms “you” or “your” refer to the person who has ordered, registered and/or used the Opal Digital Card. 

Section 1 – Opal Digital Cards

OPAL DIGITAL CARD TERMS OF USE

  1. Opal Digital Card Terms of Use: The reference to "Opal Digital Card Terms of Use" is a reference to these Opal Digital Card Terms and Conditions of Use as amended from time to time (Opal Digital Card Terms of Use). These Opal Digital Card Terms of Use are the terms and conditions that apply to your use of the Opal Digital Card.

ACCEPTANCE

  1. Acceptance of terms: By ordering, using or registering an Opal Digital Card in your Mobile Wallet, you agree to be bound by these Opal Digital Card Terms of Use in force at the time you order, use or register your Opal Digital Card. If you do not agree to be bound, you must refrain from using the Opal Digital Card.

 

OPAL DIGITAL CARDS

  1. Opal Digital Cards:EML issues the Opal Digital Cards which are reloadable stored value payment cards, provisioned within the Mobile Wallet of compatible Mobile Devices with a limited maximum balance and accepted only by providers of Transport Services authorised by the Issuer. The Opal Digital Card is not designed for, or able to be used as, a general purpose payment facility. You must have your own compatible Mobile Device in order to obtain and use an Opal Digital Card.  Neither the Issuer, nor TfNSW, will provide you with a Mobile Device, or provide advice, training, support, repairs or other services in relation to your Mobile Device.

 

  1. Property of EML and Other Parties:Opal Digital Cards are and remain the property of EML as Issuer of the product. TfNSW is and remains the owner of the Opal Digital Card mobile device application software (Opal Digital Card App) that is used to obtain an Opal Digital Card and perform certain functions in relation to its use and Opal Benefits. TfNSW or EML may inspect or request to de-activate an Opal Digital Card without notice to you at any time.

 

  1. Precondition to using an Opal Digital Card:You must observe the procedures applicable for your Mobile Device to download, activate, register and add value to an Opal Digital Card before being able to use it to pay for your first trip. Neither the Issuer, nor TfNSW, will or is able to do so for you, or on your behalf.

 

ACQUIRING AN OPAL DIGITAL CARD

  1. Where to acquire an Opal Digital Card:You can acquire an Opal Digital Card through the Opal Digital Card App provided by TfNSW.

When acquiring an Opal Digital Card, you must provide all the information that we or TfNSW deem reasonably necessary to supply you with the Opal Digital Card.

USE OF OPAL DIGITAL CARDS AND OPAL TICKETING SYSTEM Use of Opal Digital Cards: You must:

  1. use the Opal Digital Card and Opal Ticketing System, in accordance with these Opal Digital Card Terms of Use and the Opal Terms of Use available at https://transportnsw.info/tickets-opal/opal/opal-terms-of-use;
  2. not obtain or attempt to obtain Opal Benefits (as described on the TfNSW website at https://transportnsw.info/tickets-opal/opal/opal-benefits) by using an Opal Digital Card or the Opal Ticketing System (including Opal Card Readers) in a way that is inconsistent with these Opal Digital Card Terms of Use;
  3. provide us or TfNSW with the information and assistance that we or TfNSW deem reasonably necessary for the effective use of the Opal Digital Card;
  4. comply with all laws and regulations applicable to your use of the Opal Digital Card;
  5. only use an Opal Digital Card on the Opal Ticketing System and not attempt to do so for any other use or purpose;
  6. not misuse, alter or tamper with the Opal Digital Card;
  7. not attempt to alter the Opal Digital Card; and
  8. not modify, adapt, translate, disassemble, decompile, reverse engineer, create derivative works of, copy or read, obtain or attempt to discover by any means, any (i) encrypted software or encrypted data contained on an Opal Digital Card or the Opal Digital Card App; or (ii) other software or data forming part of the Opal Ticketing System.

CARD PROVISIONING IN YOUR MOBILE WALLET

  1. Provisioning an Opal Digital Card: In order to provision your Opal Digital Card you must follow the process set out in the Opal Digital Card App and any instructions for the relevant Mobile Wallet on your Mobile Device. Only one Opal Digital Card can be linked to a customer profile at any given time on the Opal Digital Card App.

 

  1. Registered Card Benefits:TfNSW offers a range of services (Registered Card Benefits) that are available for registered Opal Cards, including Opal Digital Cards. Information about Registered Card Benefits can be obtained from the TfNSW Website at https://transportnsw.info/tickets-opal/opal/opal-benefits. TfNSW may change the Registered Card Benefits at any time in accordance with these Opal Digital Card Terms of Use.

 

  1. Confidentiality:You must keep all usernames, passwords, personal identification numbers, security codes and answers to security questions confidential for your Mobile Device and you must not disclose this information to any person. You must not enable any other person, application (including any other mobile application) or system to access your customer profile. Neither the Issuer nor TfNSW are responsible for any loss suffered as a result of you disclosing any information, including any username or password contained in your customer profile to another person, any application (including any mobile application) or any system. You must also keep the Opal Digital Card and the Mobile Device on which it is stored safe and secure.

 

  1. Card authentication:When interacting with the Opal Ticketing System, you will comply with any authentication procedures that we reasonably require from time to time, which include authentication procedures that may be required by TfNSW. If you cannot satisfy any of our authentication requirements, you may not be able to interact with the Opal Ticketing System (including obtaining the Registered Card Benefits).

PAYMENT, FARES AND BALANCES

  1. Payment for travel:In connection with your use of an Opal Digital Card, you are responsible for the payment of all fares (including promotional fares, discounted fares or fares with caps) (Opal Fares) for journeys using your Opal Digital Card. Your Opal Digital Card will also be used to pay for other applicable Opal travel charges, including but not limited to Airport Station Access Fees, in connection with the use of the Opal Digital Card (Opal Charges). Information about applicable Opal Fares and Opal Charges will be published on the website at https://transportnsw.info/ (Opal Website).
  2. Opal Digital Card Balance:Your Opal Digital Card Balance will be available to pay for Opal Fares and Opal Charges, unless those amounts are unloaded or refunded in accordance with the Opal Refund and Balance Transfer Policy, or forfeited in accordance with clause 33. You must add value to your Opal Digital Card sufficient to meet these charges.

 

  1. Tap on and tap off:Subject to clause 17, when using your Opal Digital Card to pay for a trip you must tap on at the beginning of your trip and tap off at the end of your trip at an Opal Card Reader, except in the case of ferry services to and from Manly or as otherwise advised by us. For ferry services to and from Manly only, you must tap on at the beginning of your trip but you do not have to tap off at the end of your trip and you may exit without doing so. If you fail to tap on or tap off as required, the Opal Ticketing System is unable to ascertain where you entered or exited the public transport network, as the case may be, and you will be charged the default fare for the journey.

  1. Multiple use not permitted:You can only use an Opal Digital Card for one trip at a time. You must not tap on twice with the same Opal Digital Card in order to pay for another person’s trip.

 

  1. Tap on and Tap off at the one location: You are permitted to tap on and then tap off at the same location if you no longer intend to make a journey.

 

  1. Sufficient funds:You must not use your Opal Digital Card to pay the Opal Fare for a trip if the Opal Digital Card Balance is: (a) insufficient to pay for it; or (b) has a negative balance. You must not commence a trip if (a) the Opal Digital Card Balance is negative; or (b) the Opal Card Reader declines a tap on due to an insufficient balance.

 

  1. Minimum and maximum balances:A limit applies to the maximum amount that can be maintained as an Opal Digital Card Balance. Information about Opal Digital Card balances is available on the Opal Website.

 

  1. Authorisation:You authorise us to deduct all Opal Fares and Opal Charges as and when they are due from the Opal Digital Card Balance of the Opal Digital Card.

 

  1. Negative balances:If the Opal Digital Card Balance of an Opal Digital Card is insufficient to pay for the applicable Opal Fare or has a negative balance, you must add value to the Opal Digital Card in an amount sufficient to pay for your trip before you use it again. You must pay any negative Opal Digital Card Balance, and when you add value to it, the added value will be first applied to reduce any negative balance.

 

  1. Adding value via the Opal Digital Card App: You will be required to set up an automatic top up for the Opal Digital Card on the Opal Digital Card App. Information on methods of adding value can be obtained from the Opal Website or Opal Digital Card App.

 

  1. Balance adjustments:You may dispute the balance on an Opal Digital Card and request an adjustment of the Opal Digital Card Balance as described on the Opal Website. Any adjustment to an Opal Digital Card Balance will only be made at TfNSW’s discretion. TfNSW may adjust an Opal Digital Card Balance retrospectively if it discovers that it is incorrect.

 

  1. Opal Benefits not transferred: Opal Benefits (as described on the Opal Website at https://transportnsw.info/tickets-opal/opal/opal-benefits) are provided by TfNSW (and enabled by us only on their instructions), are specific to each Opal Digital Card and are not transferrable upon the transfer of the Balance to another Opal Digital Card, except where an Opal Digital Card is found to be defective and a replacement card is provisioned. For example, any paid journeys accrued for the purpose of the Weekly Travel Reward will be transferred to a new Opal Digital Card if the previous Opal Digital Card was defective.

 

  1. Auto top up: When you set up an "auto top up" for your Opal Digital Card, you are authorising us to automatically add value to your Opal Digital Card whenever your Opal Digital Card Balance falls below the required minimum balance by means of an automatic payment from: (a) a credit card; or (b) a debit card; (Authorised Payment Source).

 

  1. You can obtain information on the minimum and maximum amounts that can be automatically added under an auto top up, the methods by which you can change an auto top up and the manner in which we will handle the auto top up if your Authorised Payment Source is declined or has expired, from the Opal Digital Card App. You must ensure that your Authorised Payment Source remains valid and current and you must renew your Authorised Payment Source if it has expired or if we request you to do so. If a payment for an auto top up is declined by your Authorised Payment Source, we will notify you and will reverse that auto top up and cancel your auto top up instruction.

 

TRANSFER OF YOUR OPAL DIGITAL CARD

  1. No transfer: You must not sell, or offer to sell, an Opal Digital Card on a Mobile Device to another person. We may cancel any Opal Digital Card that is transferred in breach of this clause at any time without notice. If you have an Opal Digital Card that you no longer wish to use, you can apply for a refund of the Opal Digital Card Balance as described below.

 

  1. Use by people other than you: If your Opal Digital Card is issued specifically to you, you must not allow any other person to use, or attempt to use, the Opal Digital Card or Mobile Device on which it is stored.

 

REFUNDS

  1. Opal Refund and Balance Transfer Policy: Refunds will be made for Opal Digital Card Balances as stated in these Opal Digital Card Terms of Use and in accordance with the Opal Refund and Balance Transfer Policy.
     
  2. Applications for refunds: Where an Opal Digital Card is deactivated or cancelled under clause 32, or expires under section 35, you may apply for a refund in accordance with the Opal Refund and Balance Transfer Policy.

 

  1. Right to reject application for refund: If you make an application for a refund under clause 30, we or TfNSW may reject the claim if you have not complied with any of the provisions of these Opal Digital Card Terms of Use or if we or TfNSW have reason to suspect that an offence under any law may have been or may be committed.

 

  1. Lost or stolen Opal Digital Card:If you have lost the Mobile Device on which a Opal Digital Card is stored, or your Mobile Device is stolen, you must notify TfNSW as soon as possible by calling 13 67 25 (13 OPAL) or through the Opal Website, so that we can arrange to cancel the Opal Digital Card and arrange for a balance transfer, in accordance with the Opal Refund and Balance Transfer Policy. You remain liable for Opal Fares incurred on the Opal Digital Card until you report the device to TfNSW as lost or stolen.

 

  1. Refunds:If an Opal Digital Card is damaged or faulty: (a) you must notify us as soon as possible to request a replacement Opal Digital Card through the Opal Digital Card App; and (b) if you want a refund for an incorrectly charged trip, you must follow the process that is contained in the Opal Refund and Balance Transfer Policy.

CANCELLATION AND EXPIRATION

  1. Cancellation:We may cancel an Opal Digital Card if we or TfNSW:
    1. are satisfied that the device on which it is stored is lost, stolen, or if the Opal Digital Card is faulty;
    2. are satisfied that you have not complied with any of the provisions of these Opal Digital Card Terms of Use or if we reasonably suspect that an offence under the Passenger Transport Act 1990 may have been or may be committed by you or someone using the Opal Digital Card;
    3. deem it reasonable to do so for the purposes of providing efficient and effective ticketing services; or
    4. receive a request from you for the cancellation of an Opal Digital Card. An Opal Digital Card that has been cancelled will no longer be usable. You may apply for a refund of the balance of a cancelled Opal Digital Card in accordance with clause 30.
  2. Card Expiration:An Opal Digital Card will expire 3 years from the date it is provisioned by you (Planned Expiry). However, we may expire an Opal Digital Card earlier if we have reasonable grounds to do so (for example, if changes in the Opal Digital Card App, Mobile Device or other technology results in failures prior to their date of Planned Expiry) (Unplanned Expiry).

 

  1. Notice of expiry:You will know when an Opal Digital Card is about to expire as a card expiration message will appear on the reader display when you tap on an Opal Card Reader during the 30 day period prior to Planned Expiry, or, in the case of Unplanned Expiry, such lesser period as we may reasonably need to determine.

 

  1. Forfeiture of Opal Digital Card Balance:You can apply for a transfer or refund of your Opal Digital Card Balance in accordance with clause 30 for a period of up to 90 days after the date of cancellation or expiration of the Opal Digital Card. If you do not do so, or you are not entitled to a refund in accordance with the Opal Refund and Balance Transfer Policy, you will forfeit the Opal Digital Card Balance of that cancelled or expired Opal Digital Card to us.

 

  1. Inability to use:You will not be able to use any Opal Digital Card that has been cancelled or has expired.

 

Section 2 General

  1. Opal Refund and Balance Transfer Policy:We will make refunds for payment made by an Opal Digital Card in accordance with the Opal Refund and Balance Transfer Policy.

 

  1. Right to reject application for refund: If you make an application for a refund under clause 30, TfNSW may reject the claim if you have not complied with any of the provisions of these Opal Digital Card Terms of Use or if we or TfNSW have reason to suspect that an offence under any law may have been or may be committed.

     
  2. Amendments:We may, at any time, change any part of these Opal Digital Card Terms of Use or any other information referred to in these Opal Digital Card Terms of Use, by updating these Opal Digital Card Terms of Use or that other information accordingly on the Opal Website or on the Opal Digital Card App. Any such changes will take effect when they are published on the Opal Website or via the Opal Digital Card App. If we make any such changes that we consider will adversely affect your use of the Opal Digital Card in a material way, we will take such steps to notify you of those changes as we consider reasonably appropriate (for example, by including a notice on the Opal Digital Card App or the Opal Website). By continuing to use an Opal Digital Card after any changes are published on the Opal Website or the Opal Digital Card App, you agree to be bound by those changes. If you do not agree to any such changes, you must refrain from using the Opal Digital Card. You may apply for a refund of the Opal Digital Card Balance in accordance with the Opal Refund and Balance Transfer Policy.

 

  1. Operator’s conditions of carriage: These Opal Digital Card Terms of Use apply in addition to the Opal Terms of Use and any conditions of carriage imposed by any provider of public transport services, who accepts the Opal Digital Card as payment for use of its services (Operator). When using the services of any Operator you must comply with that Operator’s conditions of carriage. We are not responsible for the acts or omissions of any Operator.

 

  1. Accuracy of information:You represent and warrant that any information that you provide to us is true, accurate and up to date. If the information you provide changes or is out of date, you must notify us of the change as soon as possible.

 

  1. Opal Website:If and when you use the Opal Website, you must comply with the Opal Website Terms of Use.

 

  1. Opal Guidelines: You must comply with all the procedures, policies and guidelines relating to the Opal Digital Card, and the Opal Ticketing System (including, but not limited to, the Opal Terms of Use, the Opal Refund and Balance Transfer Policy, the EML Privacy Policy, the guidelines in the Opal Website and any starter packs) that are published or issued by us as each may be amended from time to time in accordance with clause 41.

 

  1. Opal Privacy Policy:TfNSW and the Issuer will handle personal information that is collected in relation to the Opal Ticketing System in accordance with the privacy policies that are published on the Opal Website, and by the Issuer as set out on its website at https://www.emlpayments.com/privacy/. Use of the Opal Digital Card or Mobile Device indicates your consent to the use and disclosure of your personal information in accordance with these policies and relevant legislation relating to personal information and privacy.

 

LAW ENFORCEMENT AND REVENUE PROTECTION

  1. Revenue protection:You must co-operate with any officer (including any NSW police officer) authorised by us to monitor fare evasion, protect revenue or enforce compliance (Authorised Officer).

 

  1. Production of Opal Digital Card:You must immediately produce the Opal Digital Card on a Mobile Device that you are using if requested to do so by an Authorised Officer. You consent to any Authorised Officer inspecting the Opal Digital Card and/or Mobile Device and viewing transactions on the Opal Digital Card. If your Mobile Device is not functional and cannot be read, you may be liable to pay a fine.

 

  1. Co-operation:You must co-operate with us and the NSW Police in endeavouring to recover an Opal Digital Card on a Mobile Device if it is lost or stolen or if we suspect any suspicious activity in relation to an Opal Digital Card or Mobile Device.
  2. Records:In the absence of manifest error, our records are conclusive of the matters to which they relate.

 

  1. Enquiries, complaints and disputes:You may raise enquiries, complaints or disputes with TfNSW by completing and sending the enquiry formavailable on the Opal Digital Card App.

 

  1. Customer instructions:Whenever you provide information or an instruction in connection with an Opal Digital Card, Mobile Device or the Opal Ticketing System to us, we are entitled to assume that you have the right and authority to provide that information or instruction to us and that we are entitled to rely on the information or instruction.

 

  1. Intellectual property rights:The Opal Digital Card, Mobile Device, the Opal Ticketing System (including related software, architecture, data or other information) and their operation are protected by copyright and other intellectual property rights that are owned by us, TfNSW, and our licensors. Similarly, other parties have intellectual property interests in connection with the Opal Card Readers and Transport Services.

 

  1. Novation:You consent and agree that, subject to applicable laws, we may at any time novate this agreement so that another institution holds our rights and obligations as issuer. You must sign any document and take any action reasonably required to give effect to this. We may disclose information about you or these terms and conditions to a party involved in an actual or proposed novation.

INTERPRETATION

  1. Proper law:These Opal Digital Card Terms of Use are governed by the laws of New South Wales and we and you submit to the exclusive jurisdiction of the courts of New South Wales.

 

  1. Unenforceability:If any part of these Opal Digital Card Terms of Use is held to be unenforceable, the unenforceable part is to be given effect to the fullest extent possible and the remainder will remain in full force and effect.

 

  1. Including:The words “including”, “such as”, “for example” and similar expressions are not intended as terms of limitation.

LIABILITY

  1. Delays:To the maximum extent permitted by law, neither we the Issuer, nor TfNSW, shall be responsible for any delays in performing any of our or their obligations under these Opal Digital Card Terms of Use and any of our or their functions under the Opal Ticketing System. To the maximum extent permitted by law, neither the Issuer, nor TfNSW, will not be liable for any loss, damage, costs or expenses incurred as a result of the failure or delay in processing any transaction including a refund, balance transfer, balance adjustment or transaction to add value.

 

  1. Exclusion of representations and warranties:Subject to clause 62, all express or implied guarantees, warranties, representations or other terms and conditions not contained in these Opal Digital Card Terms of Use are excluded from these Opal Digital Card Terms of Use to the maximum extent permitted by law.

 

  1. Times of Services: The times published in the official timetables are those at which it is intended, so far as circumstances permit, that the passenger services should arrive at, and depart from, the various bus stop, ferry wharf or station. However, the Issuer, TfNSW and/or the Operators do not guarantee the departure or arrival of services at the times stated.

 

  1. Operator Rights: Each Operator of services has and reserves the right to cancel, either wholly or in part, any of the services shown in the official timetables and vary the stops, stations or wharves at which the services will pick up or set down passengers at the times of arrival or departure, as shown in such timetables.

 

  1. Lawful remedies:Nothing in these Opal Digital Card Terms of Use excludes anything imposed by any legislation (such as the Australian Consumer Law which contains guarantees that protect the purchasers of goods and services in certain circumstances) that cannot be lawfully excluded or limited (Non-Excludable Provision). If we are able to limit your remedy for a breach of a Non-Excludable Provision, then our liability for such a breach is limited to one or more of the following at our option:
     
  2. in the case of goods, the replacement of the goods or the supply of equivalent goods, the repair of the goods, the payment of the cost of replacing the goods or of acquiring equivalent goods; or
     
  3. in the case of services, the supplying of the services again, or the payment of the cost of having the services supplied again.

 

  1. Maximum liability:Subject to our obligations under any Non-Excludable Provision and to the maximum extent permitted by law:
     
  2. our maximum aggregate liability to you for all claims under these Opal Digital Card Terms of Use is limited to $249.99; and
     
  3. we are not liable for, and no measure of damages will, under any circumstances, include special, indirect, consequential, incidental or punitive damages or damages for loss of profits, revenue, goodwill or anticipated savings.

The limitations and exclusions under this clause apply regardless of whether the claim or liability arises in contract, tort (including, without limitation, negligence), equity, under statute, based on fundamental breach or breach of a fundamental term or on any other basis, whether or not such claim, liability or damage was foreseeable.

  1. Contribution:Our liability to you (if any) is reduced to the extent that your acts or omissions (or those of a third party) contribute to or caused the loss or liability.

 

Appendix A – Samsung Pay Terms and Conditions

Samsung Pay Terms and Conditions – Opal Digital Card

 

These Samsung Pay Terms and Conditions, together with the Opal Digital Card Terms and Conditions of Use, govern your use of your eligible Opal Digital Card with Samsung Pay.

 

1 Using and managing Samsung Pay

  1. You can add an eligible Opal Digital Card to Samsung Pay on supported devices.
  2. You must be verified when adding the eligible Opal Digital Card. As part of the process we will send you a text message to your supported device with a verification code. You should ensure that Transport for New South Wales has your correct mobile number in order to receive the verification code via text message.
  3. Once you have added your Opal Digital Card to Samsung Pay and been verified, you may use your supported device to tap on and off on public transport.
  4. Your card can be unlinked from Samsung Pay through the Opal Digital Card App. If your Opal Digital Card is unlinked from your supported device, you will not be able to use your supported device to tap on and off on public transport.
  5. Samsung Pay is a service provided by Samsung, not by us. We are not responsible for any loss you suffer in relation to:
  6. any error, defect or unavailability of the Samsung Pay;
  7. any failure or refusal of Transport for New South Wales or the program manager, to process transactions using the Samsung Pay.
  8. We may exchange information with Samsung and service providers related to the set up and use of Samsung Pay. By using Samsung Pay you agree that:
  9. Samsung can provide us with information, such as your Samsung device details, for purposes including providing customer support, detecting and managing fraud, and to comply with applicable law and regulations.
  10. We can provide Samsung and its service providers with information for the purpose of operating and generally improving Samsung Pay. Samsung's data collection and handling practices are in accordance with their privacy policy (available at http://www.Samsung.com/policies/privacy/).
  11. If you don't want us to collect or disclose this information, you should not register an Opal Digital Card for use in Samsung Pay.

  4. your biometric identifier (e.g. fingerprint) is the only biometric identifier registered on your supported device;

iii. your supported device is not left unattended, is locked when not in use, and up-to-date antivirus software is installed on it; and

  1. any eligible Opal Digital Card is unlinked/removed from your supported device before disposing of it.
  2. If you fail to comply with any of the requirements in this clause 2, you are taken to have authorised others to use your supported device using Samsung Pay and you are responsible for their use of your eligible Opal Digital Card.

 

3 What to do if there is a problem

  1. You should check your transaction and fare history regularly to make sure there are no errors or unauthorised transactions.
  2. You must tell us straight away if:
  3. your eligible Opal Digital Card or supported device has been lost or stolen; or
  4. You suspect someone else has used your account without your permission or may have access to your supported device or know your security credentials .
  5. You should immediately unlink you eligible Opal Digital Card from Samsung Pay if your supported device is stolen or lost. Instructions to unlink your card are available on our website and/or the Opal Digital Card App.

 

4 Fee and charges

We do not impose any additional fees and charges for registering and using your eligible Opal Digital Card with Samsung Pay. However, you will need to pay any third party fees and charges associated with downloading, registering and using the Samsung Pay on a supported device.

 

5 Rights we have

We may suspend or terminate use of your eligible Opal Digital Card with Samsung Pay without notice at any time, including if:

  1. you ask Transport for New South Wales to suspend or close the eligible Opal Digital Card;
  2. you breach these terms and conditions;
  3. we suspect unauthorised transactions have occurred; or
  4. we are required by a regulatory or government body.

 

6 Changes to terms

We can make changes to these terms and conditions at any time. We will notify you of any material changes by electronic notice to you via your supported device or Samsung Pay. We may require you to confirm your acceptance of changes to continue using your eligible Opal Digital Card in Samsung Pay.

"eligible Opal Digital Card" means a Opal Digital Card issued by EML Payment Solutions Limited ABN 30 131 436 532, distributed by Transport for New South Wales and managed by the program manager that can be used for Samsung Pay on a supported device to tap on and off public transport. Google Pay Terms and Conditions – Opal Digital Card These Opal Digital Card Google Pay Terms and Conditions, together with the Opal Digital Card Terms and Conditions of Use govern your use of your eligible Opal Digital Card with Google Pay.

 

1 Using and managing Google Pay

  1. You can add an eligible Opal Digital Card to Google Pay on supported devices.
  2. You must be verified when adding the eligible Opal Digital Card. As part of the process we will send you a text message to your supported device with a verification code. You should ensure that Transport for New South Wales has your correct mobile number in order to receive the verification code via text message.
  3. Once you have added your Opal Digital Card to Google Pay and been verified, you may use your device to tap on and off on public transport.
  4. Your card can be unlinked from Google Pay through the Opal Digital Card App. If your Opal Digital Card is unlinked from your supported device, you will not be able to use your supported device to tap on and off on public transport.
  5. Google Pay is a service provided by Google, not by us. We are not responsible for any loss you suffer in relation to:
  6. any error, defect or unavailability of the Google Pay;
  7. any failure or refusal of Transport for New South Wales or the program manager, to process transactions using the Google Pay.
